Victoria, Texas Elder Law Attorney

Victoria County Medicaid Planning Lawyer

Elder law encompasses a broad range of legal services available for seniors and people of any age who wish to plan for their future. At my law office in Victoria, Texas, I offer a wide range of elder law services, including:

  • Medicaid planning: If you want to obtain Medicaid eligibility without spending all your life's savings, careful estate planning is important. Through the use of miller trusts and other proven legal strategies, I help my clients pursue Medicaid eligibility while improving their ability to protect their wealth.
  • Powers of attorney: Through powers of attorney, you can designate a person of your choosing to make critical financial and medical decisions on your behalf in the event that you should become incapacitated. Contact my law office to learn more about powers of attorney, including the medical power of attorney, and durable power of attorney.
  • Guardianships: If you have not designated an individual of your choosing to make medical or financial decisions on your behalf through powers of attorney instruments, your family may need to appoint a guardian on your behalf should you become unable to make such choices due to an injury or illness. There are two types of guardianships in Texas. A guardianship of the estate grants an individual the power to make financial decisions. A guardianship of the person grants an individual the power to make key life decisions, including where a person lives, if a person should be admitted to a nursing home, and other critical life decisions. I represent clients in guardianship proceedings from the establishment of the guardianship, to preparing and filing accountings, and otherwise complying with the law and duties related to a guardianship.
  • Lady Bird Deeds: Sometimes referred to as an enhanced life estate, a Lady Bird Deed may be utilized by people in Texas to shield their home from a Medicaid Estate Recovery Claim, at least for now. Lady Bird Deeds have many other benefits, including continuing to live in the property and pay property taxes at your rate rather than your children's rate, avoiding gift taxes, and avoiding probate. It can pass to your loved ones automatically upon your death. To learn more about Lady Bird Deeds, contact my Victoria, Texas law office.
  • Living wills: Also referred to as a directive to physicians and family or surrogates, a living will carefully spells out your wishes regarding feeding tubes and other life-sustaining medical treatment should you suffer a severe illness and injury that renders you unable to state your wishes. A living will can clarify your wishes and help minimize the chance of family conflict should you become incapacitated.
  • Long-term care insurance: I can advise you about long-term care insurance and help you determine if it may be right for you.
